A man already facing multiple felony charges including statutory sexual assault involving a 13-year-old victim in West Donegal Township is now facing new charges involving the same girl in Elizabethtown Borough.
Joshua Cruz, 20, whose most recent address was on East High Street near the intersection of Spruce Street, is charged by borough police with felony counts of involuntary deviate sexual intercourse, statutory sexual assault, unlawful contact with a minor and corruption of minors.
The lawyer representing Cruz on the earlier charges emphasized that his client is presumed innocent.
“I am not counsel of record regarding these new charges nor have I had the opportunity to review the specific allegations contained in the charging documents,” defense lawyer Stephen W. Grosh wrote in an email message to the Advocate. “Nevertheless, Mr. Cruz is presumed innocent of all outstanding charges, including the most recent filing. I believe it inappropriate and premature to comment any further.”
A sworn statement by Detective Matthew T. Shuey filed in court gives details of the latest accusations against Cruz. Shuey wrote that the girl had told Officer Alex Reed that she had sex with Cruz in June. Shuey wrote that the girl told Reed that she did not want to have sex with Cruz, but that Cruz “always wanted it” and she “was afraid to tell him to stop because he was bigger and she was afraid he would get angry and hurt her.”
Shuey wrote that he attended an interview with the girl at the Lancaster County Children’s Alliance in which she said Cruz told her he was 15 years old and she told him she was 13.
Cruz waived his right to a preliminary hearing on charges filed by Northwest Lancaster County Regional Police. Those charges include involuntary deviate sexual intercourse with a person less than 16 year of age, unlawful contact with a minor – sexual offenses, statutory sexual assault, aggravated indecent assault and corruption of minors. He also waived his right to a preliminary hearing on an earlier charge of corruption of minors filed by Elizabethtown Borough police; he is accused of providing marijuana to a 15-year-old boy on April 4. He is awaiting trial on those charges in the Lancaster County Court of Common Pleas.
Court papers filed for the charges in West Donegal Township indicated that Cruz was homeless and had been staying at several friends’ homes in the Elizabethtown area.
